Stop others from doing Commercial Imitation and Plagiarism

When talk about the word, ‘imitation’, we may think of ‘copying’. When we say copying, that mean something is not good, as if during exam, the people beside you will peep at your answer. Actually, not all imitation is not good. The imitation which will not cause harm, damage or injury to others will be allowed. For example, when a child imitates the ways the adult speak, it will not cause harm to them. From other point of view, in the business world, when others imitate and produce the product similar to your best selling product, will them cause harm to you?

The imitation of the registered product or item is not allowed under the IP law and regulations. Then, why the child is allowed to do the learning through imitation? As previously said by Mr. Chong Han Kwang and Mr. Chong Han Song, the imitation by child will not cause harm to others. Besides, a person’s actions, ways of doing thing will not be registered, thus, there will be no protection exist.

A person’s speaking is not able to register for IP protection but a person’s writing can be registered for IP protection. For example, the reference books. The children are able to imitate what others said, but we are not able to copy others’ writing to be as ourselves. We are able to use the sentences of writing of others, but we are not able to use it as own publication except that we cite the sentence with the author’s name. In conclusion, what the child can do, may not necessary means that we, as an adult are allowed to do, this is because the adult thinking is more complicated than a child.
