Formality Examination

  • Application is examined for any deficiencies (formalities examination) and in accordance with the set requirements under the law.

Substantive Examination

Publication for Opposition

  • Opposition for 90 days

Issuance of Certificate of Registration

  • If the Trade Mark is not opposed during the Opposition Period, the Certificate of Registration will be issued.

Between 18 to 24 months

 Trademark Validity
10 years from the filing date. Renewal can be done every 10 years

Trademark Maintenance
A Declaration of Actual Use (DAU) is to be submitted to IPOPHL according to the following schedule:

  1. Within three (3) years from the filing of the trademark application or within 3 years from the international registration date or subsequent designation date.
  2. Within one (1) year from the fifth (5th) anniversary of the registration of the mark or within 1 year from the 5th anniversary of the statement of grant of protection.
  3. Within one (1) year from the fifth (5th) anniversary of each renewal.

Eligibility of Copyright

  • Works covered by copyright that can be deposited with IPOPHL are, but are not limited to: novels, poems, plays, reference works, newspapers, advertisements, computer programs, databases, films, musical compositions, choreography, paintings, drawings, photographs, sculpture, architecture, maps and technical drawings.

Term of Protection

  • The term of protection for copyright in literary and artistic works, and in derivative works is generally the lifetime of the author plus fifty (50) years.

Submission of Industrial Design Application

  • A request for registration of the design
  • Power of Attorney signed by the Applicant.
  • A representation of the design (drawings, photographs or other adequate graphic representation of the design).
  • Priority documents and certified English translation of the priority document.

Formality Examination

  • Notification of Filing date and design number sent to applicants
  • Formalities examination conducted to check for any deficiencies.
  • Applicant will be notified to correct any deficiencies immediately

Publication Industrial Design Application

  • For 30 days

Issuance of Certificate Registration

  • Once an application is in order, a registration certificate will be issued and the application will be published in the Designs Journal. Once published, the published designs are made available for public inspection. It takes about 2 to 3 months from the submission of the application to the successful registration of a design.

Publication of Registered Industrial Design

  • Within 6 months after registration

Industrial Design Validity
15 years from the filing date. Renewal can be done every 5 years
