Submission of TradeMark Application

Formality Examination

  • Application is examined for any deficiencies (formalities examination) and in accordance with the set requirements under the law.
  • Once the application is approved Notification of Publication will be issued

Substantive Examination

  • A substantive examination takes place 6 months from the date of publication.

Publication

  • A trademark will after examination be published in the government gazette for 3 months.

Registration

  • On completion of the formalities a certificate of registration is granted.

Trademark Validity
10 years from the filing date. Renewal can be done every 10 years

  • Foreign works do not enjoy automatic protection in Cambodia, even though Cambodia is a member of the World Trade Organization’s (WTO) Agreement on Trade-Related Aspects of Intellectual Property Rights (TRIPS).
  • As not all Cambodia’s national laws are yet in accordance to the TRIPS regulations, Cambodia currently does not grant similar protection to foreign works as it does for Cambodian works. Cambodia has to comply with the TRIPS agreement by 2021.

An application for registration can be filed in English and in Khmer and must contain the following:

  • A record of the author’s real name;
  • The date when the work was first published;
  • The date when the work was created; and
  • A record of the author’s right.

Copyright Validity
Subsists during the life of creator and remain effect for another 50 years after creator death

Submission of Industrial Design Application

  • Name, address, nationality and contact details of the applicant and inventor;
  • Title of the industrial design;
  • International classification of the industrial design;
  • Indication of the kinds of products for which the industrial design is to be used;
  • Indication of novelty and protectable points of industrial design;

Examination

  • Notification of Filing date and design number sent to applicants
  • Formalities examination conducted to check for any deficiencies.
  • Applicant will be notified to correct any deficiencies immediately

Grant of Design Patent

Industrial Design Validity
15 years from the filing date. Renewal can be done every 5 years

Submission of Patent Application

  • Application form.
  • Power of Attorney.
  • Twelve (12) clear copy of the mark.
  • A list of goods or services (which closely follow the Nice International Classification).
  • The full name, nationality and registered address of the applicant.
  • Description of claim if colour or a combination of colour or a combination of colours is claimed as Trademark.
  • For marks that contain non-English words, a certified transliteration and translation.

Preliminary Examination

  • Formal Examinations are conducted within 3 months from the filing date.

Patent Publication

  • 18 months from priority date

Substantive Examination

  • A substantive examination takes place 6 months from the date of publication.

Grant of Patent
